FAR & DFARS

The Federal Acquisition Regulation (FAR) and the Defense Federal Acquisition Regulation Supplement (DFARS) govern how the government buys and how contractors must perform. Their clauses, many incorporated by reference, often decide who bears the cost when something goes wrong.

How we help

  • Reviewing solicitations and contracts to identify risky or unusual clauses
  • Interpreting clauses, including those incorporated by operation of law
  • Advising on required flow-downs to subcontractors
  • Changes, termination, inspection and payment clauses
  • DFARS requirements such as cybersecurity, specialty metals and data rights
  • Agency class deviations and new rules

The FAR overhaul

The FAR is in the middle of a government-wide rewrite, the Revolutionary FAR Overhaul. Agencies have adopted many revised FAR parts through class deviations, and formal rulemaking is under way. Contract terms, deadlines and clause numbers are changing. Contractors should read each new solicitation carefully rather than assume familiar language still applies.
